Prepayment collection regulation by tour operators in Germany - inspiration for the Czech Republic

| Abstract: | Tato bakalářská práce je zaměřena především na regulaci v oblasti vybírání záloh cestovními kancelářemi v Německu. Hlavním cílem práce je najít možné řešení pro regulaci vybírání záloh na trhu cestovních kanceláří v České republice dle německého vzoru. V teoretické části práce jsou vymezeny základní pojmy, související s cestovními kancelářemi. Praktická část se soustředí především na regulaci vybírání záloh cestovními kancelářemi. Pomocí analýzy německých právních předpisů je uvedeno, jakým způsobem dochází k limitaci záloh v Německu. Následně je provedena analýza 5 největších českých cestovních kanceláří a na jejím základě stanovena průměrná výše vybíraných záloh v České republice. Důležitým zdrojem je Závěrečná zpráva RIA, zpracovaná Ministerstvem pro místní rozvoj. Ta představuje návrh zákona, kterým by byla v ČR zavedena zákonná limitace vybíraných záloh. Zpráva je poté zkonfrontována s výzkumem, provedeným Asociací českých cestovních kanceláří a agentur, ze kterého jasně vyplývá postavení českých cestovních kanceláří proti zavedení této úpravy. Závěrem práce je opětovné vznesení návrhu na zvážení stanovení stropu pro vybírání záloh českými cestovními kancelářemi z důvodu příznivých výsledků v zahraničí a pozitivních dopadů na rizika spojená se zavedením zajišťovacího mechanismu. |

| Abstract: | This bachelor thesis is focused mainly on the prepayment collection regulation by tour operators in Germany. The main aim of the thesis is to find a possible solution for the prepayment collection regulation on the tour operator market in the Czech Republic according to the German model. The theoretical part of the thesis defines the basic terms related to tour operators. The practical part is focused mainly on the prepayment collection regulation by tour operators. Based on the carried-out analysis of the German legislation is stated, how are the prepayment collections legally regulated there. Subsequently, five largest Czech tour operators are analyzed and based on this analysis the average rate of the prepayment collections in the Czech Republic is appointed. Important source is the Regulatory impact analysis, processed by the Ministry of Regional Development of the Czech Republic. This analysis presents law proposal, which includes the implementation of the prepayment collection regulation. Afterwards, the analysis is confronted with research conducted by the Association of Tour Operators and Travel Agents of the Czech Republic. This research clearly shows the tour operators’ position against the implementation of the prepayment collection regulation. The conclusion of this thesis calls for a resubmission of the law proposal, thanks to favorable results abroad, as well as positive impacts on risks associated with the implementation of the providing mechanism. |
