| Abstract: | Tato diplomová práce se zaměřuje na srovnání rozhodčího řízení v České republice a Švýcarsku. Analyzuje právní předpisy a praxi v obou zemích a zkoumá, jak se liší v různých oblastech, jako jsou pravidla rozhodčího řízení, postup při jmenování rozhodce a podmínky na jeho osobu, arbitrabilita, procesní podmínky rozhodčího řízení a přezkum a zrušení rozhodčích nálezů. Na začátku jsou rovněž řešeny otázky mezinárodněprávní úpravy rozhodčího řízení v České republice a Švýcarsku. Důraz je kladen na porovnání popularity a efektivity obou systémů, stejně jako na formální požadavky tohoto institutu. |

| Abstract: | This thesis focuses on a comparison of arbitration in the Czech Republic and Switzerland. It analyses the legislation and practice in both countries and examines how they differ in various areas such as the rules of arbitration, the procedure for the appointment of an arbitrator and the conditions on his/her person, arbitrability, the procedural conditions of arbitration and the review and annulment of arbitral awards. At the beginning, the issues of international law regulation of arbitration in the Czech Republic and Switzerland are also addressed. Emphasis is placed on a comparison of the popularity and effectiveness of the two systems, as well as on the formal requirements of the instrument. |
