Protection of children's rights in Ukraine in the context of the Russian invasion of Ukraine: the position of the European Union and the Czech Republic

| Abstract: | Tato bakalářská práce se zabývá ochranou práv dětí přicházejících z Ukrajiny v souvislosti s ruskou invazí na Ukrajinu. Práce přibližuje politické a legislativní iniciativy, které jsou ve spojení s ochranou práv ukrajinských dětí uplatňovány na území Evropské unie (EU). Specificky se zde zkoumá role EU jako aktéra a s tím spojený vliv této instituce v České republice na postupy řešící ochranu práv dětí z Ukrajiny. Teoretická část podrobněji rozebírá aktérství Evropské unie a především dimenzi EU coby rámujícího aktéra. Téma ochrany práv ukrajinských dětí a pozice EU a České republiky je blíže rozebírána v případové studii, kde se rovněž promítá teoretický koncept. Případová studie je zastřešena obsahovou analýzou syntetizující výsledky empirických dat. V případě Evropské unie se bakalářská práce zaměřuje na její vybrané instituce, jedná se o Radu Evropské unie, Evropskou radu, Evropskou komisi a Evropský parlament. Hlavním zjištěním analýzy je prokázání vlivu Evropské unie na Českou republiku v řešení problematiky ochrany práv dětí vysídlených z Ukrajiny. Zároveň je zde dokázáno, že v případě ochrany práv dítěte v tomto specifickém případě Česká republika jedná nad rámec nařízení, opatření a stanovisek EU, jež jsou platná pro všechny členské státy. Obě strany se snaží posílit ochranu práv dětí a nabídnout příchozím dětem patřičnou pomoc a ochranu. Aktivní přístup Evropské unie i České republiky z hlediska ochrany práv dětí na Ukrajině v souvislosti s ruskou invazí na Ukrajinu je na území Evropské unie a specificky na území České republiky prokazatelný. |

| Abstract: | This bachelor thesis deals with the protection of the rights of children coming from Ukraine in the context of the Russian invasion of Ukraine. The thesis presents the political and legislative initiatives that are being implemented in the European Union (EU) in relation to the protection of the rights of Ukrainian children. Specifically, it examines the role of the EU as an actor and the related influence of this institution in the Czech Republic on the procedures addressing the protection of the rights of children from Ukraine. The theoretical part discusses in more detail the actorness of the European Union and especially the dimension of the EU as a framing actor. The topic of the protection of the rights of Ukrainian children and the position of the EU and the Czech Republic is further discussed in the case study, where the theoretical concept is also reflected. The case study is covered by a content analysis synthesizing the results of the empirical data. In the case of the European Union, the bachelor thesis focuses on its selected institutions, namely the Council of the European Union, the European Council, the European Commission and the European Parliament. The main finding of the analysis is to demonstrate the influence of the European Union on the Czech Republic in addressing the issue of protection of the rights of children displaced from Ukraine. At the same time, it has been shown that in the case of the protection of children's rights in this specific case, the Czech Republic is acting beyond the scope of EU regulations, measures and opinions that are valid for all Member States. Both sides are trying to strengthen the protection of children's rights and to offer appropriate assistance and protection to the arriving children. The active approach of both the European Union and the Czech Republic in terms of protecting the rights of children in Ukraine in the context of the Russian invasion of Ukraine is demonstrable on the territory of the European Union and specifically on the territory of the Czech Republic. |
