Hlavním předmětem této bakalářské práce je analýza trhů s marihuanou pro osobní užití na regulovaných trzích, dekriminalizace držby a užití marihuany. Hlavní hypotézou práce je popisná statistická analýza dat trhu s marihuanou ve státech, kde je trh regulován či dekriminalizován a jaký vliv mají na trh ekonomické regulace a právní normy daných států a který systém je ekonomicky nejvíce přínosný, co se týče daňových výnosů a který je pro společnost nejméně nákladný, skrze dopad na zdravotní systém a náklady na vymáhání práva. Tato práce se zabývá legalizací a regulací marihuany pro osobní užití v Uruguayi, Kanadě, Spojených státech amerických, Nizozemsku a v České republice. Uruguay zahájila jako první legalizaci v podobě státního monopolu v roce 2013, přičemž kladla důraz na snižování škod a státní regulaci. Kdyby Česká republika přijala legalizaci marihuany pro osobní užití, měli by se jí zmenšit náklady na vymáhání práva, jak jde pozorovat u ostatních států se zavedenou regulací, kde se zmenšila kriminalita až o 20%–25%. Snížila by se i velikost nelegálního trhu a pěstování, jenž by se přesunul na licencovaný způsob prodeje, distribuce a pěstování, jako u Kanady, kdy od zavedení legalizace, se nelegální trh snížil na 44 %. A díky legalizaci by získala příjem z DPH a spotřební daně na marihuanu. |

The focus of this bachelor thesis is the analysis of marijuana markets for personal use in regulated markets, decriminalization of marijuana possession and use. The main hypothesis of the thesis is a descriptive statistical analysis of marijuana market data in states where the market is regulated or decriminalized and what effect the economic regulations and legal standards of the states have on the market and which system is the most economically beneficial in terms of tax revenue and which is the least costly to society through its impact on the health care system and law enforcement costs. This paper examines the legalisation and regulation of marijuana for personal use in Uruguay, Canada, the United States, the Netherlands and the Czech Republic. Uruguay launched the first legalization in the form of a state monopoly in 2013, with an emphasis on harm reduction and state regulation. If the Czech Republic were to adopt the legalization of marijuana for personal use, it should see a reduction in law enforcement costs, as seen in other countries with regulation in place, where crime has been reduced by as much as 20%-25%. It would also reduce the size of the black market and cultivation, which would shift to licensed sales, distribution and cultivation, as in Canada, where the black market has decreased to 44% since legalization. And legalization would provide revenue from VAT and excise taxes on marijuana. |
