Téma ochrany oznamovatelů se stává stále důležitějším v rámci evropského právního prostoru, zvláště po zavedení směrnice Evropského parlamentu a Rady EU v roce 2019, která ukládá členským státům povinnost chránit oznamovatele protiprávních jednání. Tato diplomová práce se zaměřuje na analýzu implementace zákona č. 171/2023 Sb., o ochraně oznamovatelů, v České republice, se specifickým zaměřením na města s více než 10 000 obyvateli. Cílem práce je zhodnotit, jak města přistoupila k zavedení vnitřních oznamovacích systémů, jaké nástroje a postupy zavedla pro zajištění ochrany oznamovatelů a jaký byl reálný dopad těchto opatření na praxi. Výzkum byl proveden prostřednictvím dotazníkového šetření, které zahrnovalo jak městské úřady, tak zaměstnance těchto úřadů, aby bylo možné získat komplexní obraz o aktuálním stavu informovanosti a využívání oznamovacích systémů. Výsledky ukazují, že i přes legislativní snahy zůstává povědomí o ochraně oznamovatelů mezi zaměstnanci často nedostatečné, což snižuje efektivitu těchto systémů. Důležitým zjištěním je také vysoká míra nedůvěry zaměstnanců vůči interním příslušným osobám a s tím související preference podávání anonymních oznámení. Na základě výsledků výzkumu byla formulována doporučení, jak zvýšit důvěryhodnost oznamovacích systémů a podpořit zaměstnance k jejich využívání. Tato doporučení zahrnují zlepšení komunikace a informovanosti o možnostech oznamování, zavedení specifických a praktických školení, zajištění transparentnosti a pravidelné zpětné vazby a rozšíření podpory anonymního oznamování. Práce tak nabízí cenné poznatky pro veřejnou správu a další organizace, které se budou v budoucnu zabývat ochranou oznamovatelů, a přináší doporučení pro efektivnější implementaci a využití těchto systémů. |

The topic of whistleblower protection is becoming increasingly important within the European legal area, especially after the introduction of the Directive of the European Parliament and the Council of the EU in 2019, which obliges Member States to protect whistleblowers. This thesis focuses on the analysis of the implementation of Act No. 171/2023 Coll. on the protection of whistleblowers in the Czech Republic, with a specific focus on cities with more than 10,000 inhabitants. The aim of the thesis is to assess how cities have approached the introduction of internal whistleblowing systems, what tools and procedures they have put in place to ensure whistleblower protection and what the real impact of these measures has been in practice. The research was conducted through a questionnaire survey that included both city authorities and employees of these authorities in order to obtain a comprehensive picture of the current state of awareness and use of whistleblowing systems. The results show that despite legislative efforts, awareness of whistleblower protection among staff often remains insufficient, which reduces the effectiveness of these systems. An important finding is also the high level of distrust of staff towards internal competent persons and the related preference for anonymous reporting. Based on the results of the research, recommendations have been made to increase the credibility of whistleblowing systems and to encourage staff to use them. These recommendations include improving communication and awareness of whistleblowing options, introducing specific and practical training, ensuring transparency and regular feedback, and expanding support for anonymous whistleblowing. The paper thus offers valuable insights for public administrations and other organisations concerned with whistleblower protection in the future and makes recommendations for more effective implementation and use of these systems. |
