Diplomová práce se zabývá tématem výpovědi z pracovního poměru jakožto jedním z nejdůležitějších způsobů skončení pracovního poměru zaměstnance. S ohledem na velké množství novel zákoníku práce, a to ať už již proběhlých, či ještě připravovaných, se jedná o mimořádně aktuální téma, které se dotýká prakticky každého, kdo vstupuje do pracovněprávních vztahů se zaměstnavatelem. Diplomová práce se zabývá otázkou, zda je pro zaměstnance či zaměstnavatele příznivější právní úprava česká či právní úprava německá. V práci jsou dále identifikovány instituty, které by se mohly stát inspirací pro zákonodárce českého a německého. V diplomové práci je rovněž provedena analýza vybraných rozhodnutí nejvyšších soudních instancí České republiky a Spolkové republiky Německo. Členěna je diplomová práce do 6 kapitol. V první kapitole je pojednáno o tom, jak jsou otázky týkající se pracovního práva upraveny na úrovni Evropské unie. V kapitole druhé a třetí je poskytnut přehled o právní úpravě institutu výpovědi v ČR a SRN (náležitosti výpovědi, výpovědní doba, výpovědní důvody, zákaz výpovědi, obrana proti neplatné výpovědi a odstupné). Obsahem kapitoly čtvrté je komparace právní úpravy institutu výpovědi v ČR a SRN, jejíž systematika vychází z kapitol teoretické části. Součástí této kapitoly je i podkapitola upozorňující na instituty pracovního práva, které jsou známé pouze německé právní úpravě (např. výpověď s možností změny pracovních podmínek). Kapitola pátá a šestá obsahují analýzu 6 vybraných recentních rozhodnutí Nejvyššího soudu ČR a Spolkového pracovního soudu SRN. |

The diploma thesis deals with the topic of notice of termination as one of the most important ways of terminating an employment relationship of an employee. In view of the large number of changes to the Labour Code, both past and forthcoming, this is an extremely current issue that affects practically everyone who enters into employment relations with an employer. The thesis deals with the question of whether the Czech or the German legal regulation is more favourable for the employee or the employer. The thesis also identifies institutes that could become an inspiration for the Czech and German legislators. The thesis also analyses selected decisions of the highest courts of the Czech Republic and the Federal Republic of Germany. The thesis is divided into 6 chapters. The first chapter deals with how issues related to labour law are regulated at the level of the European Union. The second and third chapters provide an overview of the legal regulation of the institute of notice of termination in the Czech Republic and the Federal Republic of Germany (requirements of notice, notice period, reasons for notice, prohibition of notice, defence against void notice and severance pay). The content of chapter four is a comparative analysis of the legal regulation of the institute of notice of termination in the Czech Republic and the Federal Republic of Germany, the systematics of which is based on the chapters of the theoretical part. This chapter also includes a subchapter pointing out labour law institutes that are known only in German law (e.g. notice of termination with the possibility of changing the terms of employment). Chapters five and six contain an analysis of 6 selected recent decisions of the Supreme Court of the Czech Republic and the Federal Labour Court of the Federal Republic of Germany. |
