| Abstract: | Tato bakalářská práce se zaměřuje na problematiku právní úpravy náhrady škody v mezinárodní letecké dopravě, se zvláštním důrazem na přepravu osob. Analyzuje historický vývoj, současnou vnitrostátní, evropskou i mezinárodní právní úpravu v této oblasti, přičemž věnuje zvláštní pozornost vlivu Montrealské úmluvy a nařízení Evropského parlamentu a Rady č. 261/2004. Práce zahrnuje také empirický výzkum zaměřený na povědomí spotřebitelů o jejich právech, zkušenosti s jejich uplatněním a roli dozorových orgánů, jako je Úřad pro civilní letectví. Na základě zjištěných nedostatků právní úpravy a aplikační praxe přináší návrhy na zlepšení ochrany práv poškozených cestujících a efektivity jejich vymáhání. Cílem práce je přispět k pochopení problematiky náhrady škody v mezinárodní letecké dopravě a navrhnout opatření vedoucí k vyšší právní jistotě pro cestující i dopravce. |

| Abstract: | This bachelor’s thesis focuses on the legal framework for damage compensation in international air transport, with a particular emphasis on passenger transport. It examines the historical development and current national, European, and international regulations in this field, with special attention to the impact of the Montreal Convention and Regulation (EC) No. 261/2004. The thesis also includes empirical research on consumer awareness of their rights, their experiences in enforcing those rights, and the role of supervisory authorities, such as the Civil Aviation Authority. Based on identified shortcomings in the legal framework and its application, the thesis offers recommendations to improve the protection of passengers' rights and the efficiency of claim enforcement. The goal of the thesis is to contribute to the understanding of damage compensation issues in international air transport and to propose measures leading to greater legal certainty for both passengers and carriers. |
