| Abstract: | Tématem této diplomové práce je fenomén migrace, neboli mezinárodního či přeshraničního pohybu osob, a to v kontextu Paktu o migraci a azylu, jenž byl přijat v květnu letošního roku (2024). Časovým rámcem pro zkoumání tématu diplomové práce je funkční období Komise mezi lety 2019 až 2024 pod vedením Ursuly von der Leyen. Pakt o migraci a azylu zásadním způsobem reformuje současnou podobu společné migrační a azylové politiky a do unijního migračního a azylového acquis zavádí nové právní instituty, jako je například povinný mechanismus flexibilní solidarity, systém prověřování žadatelů o azyl na vnějších hranicích Unie či jednotné postupy a kritéria pro vyhodnocování žádostí o azyl. Cílem této diplomové práce však není podat kompletní výčet všech změn, jež Pakt do unijního migračního a azylového práva zavádí, nýbrž kriticky zhodnotit, zda tyto změny reflektují unijní hodnoty, konkrétně zásadu ochrany lidských práv a princip solidarity. Lidská práva a solidarita jsou totiž základními předpoklady pro fungující migrační a azylovou politiku EU. Vzhledem tomu, že téma migrace ve společnosti v posledních letech silně rezonuje, bude implementace a následná aplikace letos přijatého Paktu o migraci a azylu v popředí politického i veřejného zájmu. Z toho důvodu má smysl se tímto tématem zabývat i na akademické půdě. |

| Abstract: | The topic of this thesis is the phenomenon of migration, or the international or cross-border movement of persons, in the context of the Pact on Migration and Asylum, which was adopted in May this year (2024). The timeframe for exploring the topic of the thesis is the Commission's term of office between 2019 and 2024 under the leadership of Ursula von der Leyen. The Pact on Migration and Asylum fundamentally reforms the current design of the Common Migration and Asylum Policy and introduces new legal institutes into the EU migration and asylum acquis, such as a mandatory flexible solidarity mechanism, a system for screening asylum seekers at the external borders of the Union, and uniform procedures and criteria for assessing asylum applications. However, the aim of this thesis is not to provide a complete list of all the changes introduced by the Pact on Migration and Asylum into EU migration and asylum law, but to critically assess whether these changes reflect EU values, namely the principle of human rights and the principle of solidarity. As human rights and solidarity are fundamental prerequisites for a functioning EU Migration and Asylum Policy, the implementation and subsequent application of the Pact will be at the forefront of political and public interest. For this reason, it makes sense to address this topic in the academic sphere as well. |
