| Abstract: | Velice dlouhou dobu neexistovala v České republice žádná právní úprava zaměřující se na ochranu oznamovatelů protiprávního jednání. V roce 2019 však vešla v účinnost příslušná směrnice Evropské unie a na jejím základě vznikl v roce 2023 zákon č. 171/2023 Sb., o ochraně oznamovatelů. Cílem práce je zmapovat aktuální právní úpravu oznamování protiprávního jednání (whistleblowingu) pomocí analýzy právních předpisů, formou konzultace s pověřenými osobami zjistit, jakým způsobem funguje zřizování oznamovacích kanálů v rámci českých společností a vyhledat a seznámit čtenáře s českými i zahraničními kauzami s aspektem whistleblowingu. Práce by měla jak poskytnout komplexní pohled na právní úpravu a její koexistenci s ostatními právními předpisy, tak umožnit čtenáři udělat si představu o důležitosti whistleblowingu a jeho přítomnosti v praxi. |

| Abstract: | For a long time, there was no legal regulation in the Czech Republic specifically focused on the protection of whistleblowers reporting unlawful conduct. However, in 2019, the relevant European Union directive came into effect, and based on it, Act No. 171/2023 Coll., on the Protection of Whistleblowers, was adopted in 2023. The aim of this thesis is to map the current legal regulation of reporting unlawful conduct (whistleblowing) through the analysis of legal regulations, to consult with designated persons in order to determine how whistleblowing channels are being established within Czech companies, and to identify and introduce both Czech and international cases involving aspects of whistleblowing. The thesis should provide a comprehensive view of the legal framework and its coexistence with other legal regulations, while also allowing the reader to form an understanding of the importance of whistleblowing and its presence in practice. |
