| Abstract: | Tato diplomová práce se zaměřuje na právní úpravu agenturního zaměstnávání v České republice a Nizozemsku, přičemž zvláštní pozornost je věnována agenturám práce jako specifické formě podnikání, a to zejména z hlediska podmínek jejich vzniku a fungování. Agenturní zaměstnávání představuje flexibilní formu pracovního vztahu, která odpovídá proměnlivým požadavkům trhu práce, současně však vyvolává řadu otázek, zejména v oblasti právní regulace, rovného postavení agenturních zaměstnanců a transparentnosti procesu zakládání agentur práce. Práce si klade za cíl poukázat na klíčové rozdíly v právní úpravě tohoto institutu mezi uvedenými zeměmi, přispět k hlubšímu pochopení tohoto specifického právního institutu a poukázat na některé problematické oblasti spojených s procesem zakládání agentur práce na základě srovnání v rámci uvedených zemí. V návaznosti na to poskytnout úvahy de lege ferenda pro tyto oblasti právní úpravy. |

| Abstract: | This thesis focuses on the legal regulation of agency employment in the Czech Republic and the Netherlands, with special attention paid to private employment agencies as a specific form of business, especially regarding the conditions of their establishment and operation. Agency employment represents a flexible form of employment relationship that meets the changing demands of the labour market, but at the same time raises several questions, especially in the area of legal regulation, the equal status of agency workers, and the transparency of the process of establishing employment agencies. The thesis aims to highlight the key differences in the legal regulation between the countries mentioned above, to contribute to a deeper understanding of this specific legal institution, and to highlight some of the problematic areas related to the process of setting up private employment agencies based on comparisons within the selected countries. Following this, to provide de lege ferenda considerations for these areas of regulation. |
