Bakalářská práce se zabývá problematikou autorských práv ve vztahu ke generativní umělé inteligenci, konkrétně k modelu Midjourney. Práce zkoumá zda a v jaké míře tento model při své činnosti využívá autorským právem chráněné prvky a nastiňuje možnosti ochrany autorských děl proti zneužití AI modely. Práce analyzuje principy fungování generativního modelu Midjourney včetně role lidského tvůrce i samotné umělé inteligence při vzniku obrazového díla. Text současně nastiňuje aktuální právní a etické výzvy spojené s generativní AI. Výzkum kombinuje literární rešerši s praktickým experimentem a dotazníkovým šetřením zaměřeným na schopnost uživatelů rozlišit AI tvorbu od lidské. Práce si klade za cíl odpovědět na otázky: Na jakých datech se generativní modely učí? Jak se proměňuje koncept originality a autorství v kontextu generativní AI? Jak se k celé situaci staví právní prostředí? |

The bachelor thesis deals with copyright issues in relation to generative artificial intelligence, specifically the Midjourney model. The thesis examines whether and to what extent this model uses copyrighted elements in its operation and outlines the possibilities of protecting copyrighted works against misuse by AI models. The thesis analyses the principles of operation of the generative Midjourney model, including the role of the human creator and the AI itself in the creation of the image work. The text also outlines the current legal and ethical challenges associated with generative AI. The research combines a literature search with a practical experiment and a questionnaire survey focused on users' ability to distinguish AI creation from human creation. The thesis aims to answer the questions: On what data do generative models learn? How does the concept of originality and authorship change in the context of generative AI? How does the legal environment approach the whole situation? |
