Regulation of Tourism in the European Union

This bachelor’s thesis focuses on the legal regulation of tourism within the European Union, with a specific emphasis on the Czech Republic and Croatia. The main objective of the thesis is to identify current legal measures and regulatory frameworks at the EU level and within the two selected member states, to analyse their effectiveness particularly in the context of overtourism, and to propose potential measures applicable within the Czech legal framework. The thesis is based on descriptive and comparative methodology, including case studies of Prague and Dubrovnik as destinations significantly affected by overtourism. It also includes an analysis of the draft policy framework for a tourism development support act in the Czech Republic. The findings suggest that the EU provides primarily supportive instruments, while specific regulation remains the responsibility of the member states. The comparison shows that Croatia, owing to clearer competencies in tourism governance, has already introduced measures that, with certain adjustments, could be implemented within the Czech legal system. The proposed measures aim to support regional development, mitigate the negative impacts of overtourism, and improve the quality of life for local residents.
