Tato bakalářská práce se zaměřuje na analýzu judikatury Soudního dvora Evropské unie (SDEU) v oblasti ochrany spotřebitele v cestovním ruchu, a to především ve světle pandemie covid-19. Cílem je posoudit, jak pandemická krize prověřila právní rámec směrnice 2015/2302 o souborných cestovních službách a jakými rozhodnutími na vzniklé výzvy SDEU reagoval. Práce systematicky zkoumá všechny dostupné rozsudky týkající se této směrnice, přičemž se zaměřuje na otázky právní jistoty cestujících, odpovědnosti pořadatelů zájezdů a meze výjimek při zásazích vyšší moci. Výzkum dokázal, že pandemická judikatura odhalila dosud nejasné nebo chybějící aspekty právní úpravy, zejména ve vztahu ke globálním krizím a že SDEU při jejich řešení důsledně trval na zachování vysoké úrovně ochrany spotřebitele i v mimořádných situacích. Práce dále analyzuje právní konflikt mezi unijním právem a národními krizovými opatřeními, jakou byl i český „lex voucher“, a upozorňuje na potenciální dopady takových opatření. |

| Abstract: |
This bachelor thesis focuses on the analysis of the case law of the Court of Justice of the European Union (CJEU) in the field of consumer protection in tourism, particularly in the context of the COVID-19 pandemic. The aim is to assess how the pandemic tested the legal framework of Directive 2015/2302 on package travel and how the CJEU responded to the challenges that arose. The thesis systematically examines all available rulings related to this Directive, with a focus on issues of legal certainty for travelers, the liability of tour operators, and the boundaries of exceptions in cases of force majeure. The research shows that the pandemic-related case law revealed previously unclear or missing aspects of the legal framework, particularly in relation to global crises, and that the CJEU consistently upheld a high level of consumer protection even in extraordinary circumstances. The thesis also analyzes the legal conflict between EU law and national emergency measures, such as the Czech “lex voucher” law, and highlights the potential implications of such measures. |
