Abstrakt:
Práce se zabývá správními poplatky spojenými s licencováním poskytovatelů služeb souvisejících s kryptoaktivy v členských státech EU po vstupu nařízení MiCA v účinnost. Vychází z předpokladu, že sjednocení licenčních podmínek a mechanismus pasportizace zúžily okruh kritérií odlišujících jednotlivé jurisdikce, a do popředí se tak mohly dostat náklady na licenci. Cílem je porovnat výši poplatků napříč členskými státy a ověřit hypotézu o korelaci mezi nižšími poplatky a vyšší koncentrací licencovaných subjektů. Náklady byly vyčísleny na dvou modelových subjektech odlišné velikosti a porovnány s rozmístěním subjektů podle rejstříku ESMA Spearmanovým koeficientem pořadové korelace. Test hypotézu nepotvrdil; koeficienty nebyly statisticky významné. Výše správních poplatků tedy není pro volbu státu sídla určujícím kritériem, přestože rozdíly mezi státy zůstávají řádové.

This thesis examines the administrative fees associated with licensing crypto-asset service providers in EU Member States following the entry into force of the MiCA Regulation. It builds on the premise that harmonized licensing conditions and the passporting mechanism narrowed the criteria distinguishing individual jurisdictions, potentially bringing licensing costs to the forefront. The aim is to compare fee levels across Member States and test the hypothesis that lower administrative fees correlate with a higher concentration of licensed entities. Costs were quantified for two model entities of different sizes and compared with the distribution of licensed entities in the ESMA register using Spearman's rank correlation coefficient. The test did not support the hypothesis; the coefficients were not statistically significant. The level of administrative fees is therefore not a decisive criterion for the choice of domicile, even though differences between Member States remain orders of magnitude apart.
