| Abstract: | Disertační práce se zabývá kolektivní správou autorských práv a práv s právem autorským souvisejících jako jednoho z prostředků vymahatelnosti autorského práva v informační společnosti. V prostředí charakterizovaném prudkým rozvojem nových médií, především internetu, zaváděním nových obchodní modelů založených na prostředí on-line a pokračujícím procesem digitalizace, význam kolektivní správy výrazně roste. Cílem disertační práce je zjistit, do jaké míry je fungování kolektivní správy tak, jak je vymezeno současnou právní úpravou v ČR, účelné a účinné při vymáhání autorských práv. Za tímto účelem byla identifikována hodnotící kritéria, která jsou relevantní pro posouzení efektivity kolektivní správy, a to jak z pohledu nositelů práv, tak z pohledu uživatelů předmětů ochrany. |

| Abstract: | The PhD thesis deals with collective management of copyright and rights related to copyright as one of the means of enforcing copyright in the information society. In an environment characterized by the rapid development of new media, especially the Internet, the introduction of new business models based on the online environment and the ongoing digitization process, the importance of collective management rises substantially. The aim of the thesis is to find out to what extent the functioning of collective management as regulated by current legislation in the Czech Republic is effective and efficient in the enforcement of copyright. For this purpose, evaluation criteria relevant to assessing the effectiveness of collective management, both from the point of view of rightholders and users, have been identified. |
