| Abstract: | Hlavním cílem předkládané diplomové práce je identifikace mezer v právní úpravě pomocí kritéria předvídatelnosti rozhodnutí soudu, následné zhodnocení a představení úvah de lege ferenda. První část práce je věnována rešerši a představení právní úpravy týkající se problematiky zaměstnávání těhotných žen. Druhá a třetí část práce je výzkumná, druhá zahrnuje soudní rozhodnutí českých soudů a třetí se věnuje soudním rozhodnutím SDEU. Ve druhé části je připojeno stanovisko ombudsmana k podnětu, jehož téma doplňuje zkoumanou problematiku. Pro dosažení cíle byly využity metody analýzy a komparace. V závěru jsou představeny výsledky výzkumu. V případě identifikace mezer v právní úpravě jsou prezentovány úvahy de lege ferenda. |

| Abstract: | The main goal of the presented diploma thesis is the identification of gaps in the legal regulation using the criterion of predictability of the court's decision, subsequent evaluation and presentation of considerations de lege ferenda. The first part of the work is devoted to the research and presentation of the legislation regarding the issue of employment of pregnant women. The second part and third part of the diploma thesis are researching, the second includes judicial decisions of Czech courts and the third is devoted to judicial decisions of the CJEU. In the second part, the ombudsman's opinion on the initiative is attached, the topic of which complements the examined issue. Analysis and comparison methods were used to achieve the goal. At the end, results of the research are presented. De lege ferenda considerations are presented in case of identification of gaps in the legislation. |
